How Tax Auctions Work

States that use Tax Deed Auctions

Tax Deed States:
In these states, properties with unpaid taxes are foreclosed on by the local government and the property itself is sold to the highest bidder.
  • Alaska
  • Arkansas
  • California
  • Idaho
  • Kansas
  • Maine
  • Michigan
  • Minnesota
  • New Hampshire
  • New Mexico
  • North Carolina

States that use Tax Lien Auctions

Tax Lien States:
These states use a system where at auction investors buy the debt of unpaid property taxes, not the property itself. Unlike states that bid on a premium or a percentage of the property, investors bid on the interest rate they are willing to accept, from the property owner, for the tax debt. The property owner has a redemption period in which to pay the tax debt and interest to redeem their property. If the redemption period passes and the owner still has not paid the debt the lienholder can initiate a judicial foreclosure action, through the county superior court, to obtain a deed to the property.

States that use Redemable Deed Auctions

Redeemable Deed States:
These states use a tax deed sale in a public auction where the county sells a property to recover delinquent property taxes, and the winning bidder receives a deed subject to a strict statutory right of redemption.
  • Connecticut
  • Delaware
  • Georgia
  • Hawaii
  • Louisiana
  • Massachusetts
  • Rhode Island
  • Tennessee
  • Texas

States that use a Hybrid of Lien & Deed Auctions

Hybrid Deed States:
These States use a two-step hybrid system where it starts by selling Tax Lien Certificates (debt) and can escalate to a Tax Deed Sale (property ownership) if the owner does not pay.
  • Florida
  • Illinois
  • Indiana
  • Nevada
  • New York
  • Ohio
  • West Virginia
